TERMS OF SERVICE

The following Terms of Service apply only to NON-COMMERCIAL projects. These terms may be subject to revisions without prior notice, but will not be applied retroactively.

By electing to commission Pug ("the Artist"), you hereby agree to the following...

​

General

  • Commission inquiries must always be made via email by contacting the Artist at pugsales@gmail.com unless otherwise directed.

  • Most subjects allowed, but please ask prior to making a formal request.

    • Please use common sense, as the Artist will not draw anything hateful, illegal, or with potential to harm the emotional wellbeing of others.
  • When sending a commission inquiry, please allow up to one (1) week for response.​

Pricing

  • All prices displayed are base prices, and may be subject to adjustment if a piece is particularly complex or detail-heavy.

  • Payment must be made in full one (1) week from receipt. Artwork priced $100+ can be paid in separate, equal installments via Paypal Invoice "split-pay" option over time, but must be paid in full prior to the work's completion.

  • Payment is only accepted via Paypal Invoice. There are no alternative payment methods at this time.

Workflow & Deadlines

  • The Artist only works commissions on Thursdays and Fridays.

    • Because the Artist only works commissions two days per week, the Client will only receive updates as significant progress is made; est. once per week until completed.

    • The Client is free to contact the Artist about changes and edits in the week preceding the two-day work period, so long as it is understood that there may not yet be significant progress ready at that time.

  • The Artist will always give a projected estimated time of arrival ("ETA") upon payment.

    • The ETA is subject to change depending on Client response time and any potential edits requested prior to the work's completion, though will not likely extend more than one to two weeks.

    • The Client will be kept updated should an ETA be extended more than two to three weeks from the initial receipt.

  • Fastest turnaround time is one to two weeks from receipt. Turnaround varies depending on the size of the docket and the complexity of requests in the current queue. 

    • Rush-order may be available at 50% of your final total on a strict case-by-case basis.

Deadlines must be discussed within the initial contact e-mail so that the Artist may determine if there is enough time allotted to complete the piece. It is always encouraged to plan two to three months in advance for time-sensitive commission requests.

Usage

  • Commissioned works are for PERSONAL USE ONLY. Artworks may not be redistributed for digital, or physical resale unless otherwise agreed upon in the initial contract.

    • The Client reserves the right to crop, alter, and otherwise edit and repost a commissioned piece, so long as it is not for resale.

    • In the event that the art is posted to the Client's personal socials in full,  removing of the signature under any circumstances is prohibited. Signature need not be present on cropped or altered works, commissioned emotes, or avatars, so long as proper credit to the Artist is given.

  • The Artist retains ALL rights to display and redistribute commissioned works as digital files and downloads on any personal gallery, portfolio, website, social media site, subscription site, and online store. 

    • The Client retains ALL rights to their own intellectual property.

    • The Client may request a commissioned work remain private at an additional 50% of the final total, and maintain sole publishing, but non-commercial rights.

  • Full rights to any commissioned piece may be purchased at a commercial fee, but only under the agreement that completed works may not, under any circumstances, be used for non-fungible tokens or any type of association with the blockchain for advertising or profit.

  • All rights otherwise unmentioned above are reserved for the Artist.

Refusal and Cancellation of Service

  • The Artist retains the full right to deny service for any reason.

  • If at any point the Client must cancel mid-service, the Client will be given a full or partial refund equal to the amount of work already completed.

  • Should the Artist cancel mid-service for any reason, the Client will be given a full refund.

  • Should the Client break ToS at any time during service, the Client forfeits their refund, and the commission will be cancelled.
